BURD Home Health Terms of Use

  1. BURD Home Health SMS Notifications are to provide notices informing you when your visits are and to ensure that you are clocking in and out for each of your visits. Also, the notifications are to inform you of upcoming seminars, document requirements and other notifications.

  2. You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first-time and we will start sending SMS messages to you again.

  3. If you are experiencing issues with messaging you can get help by texting "HELP" or contacting us directly at support@burdhomehealth.com.

  4. Carriers are not liable for delayed or undelivered messages

  5. As always, message and data rates may apply for any messages sent to you from us and to us from you. The message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

  6. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

Consent to Electronic Communications

When you provide us with your e-mail and/or phone number or communicate with us electronically via e-mail, text message, or messages via the Site, you consent to receive communications from us electronically through the number(s) or e-mail you provide. Therefore, you agree to promptly notify us if you change your contact information by updating this information in your account settings. If you later decide that you do not want to receive future communications electronically, please send an email to support@burdhomehealth.

 

You may also opt out of marketing-related electronic communications through your account or by following the unsubscribe instructions in any communication you receive from us. Your withdrawal of consent will be effective within a reasonable time after we receive your withdrawal notice described above. Your withdrawal of consent will not affect the legal validity or enforceability of these TOU provided to and accepted by you.

 

Even if you opt out, we may need to continue to send you certain communications electronically regarding your access and use of the Site, such as reminders to log into the Site and enter certain demographic or health information. You will not be able to opt out of those communications. If you withdraw your consent to receive communications electronically, certain Site functionalities may become unavailable to you, or may prevent you from using the Site entirely.

 

BURD Home Health will make reasonable efforts to ensure that communication is secure, private, and meets your communication preferences; however, we cannot guarantee that information shared via electronic means is 100% secure given the risks inherent in electronic communication.

 

In consideration of the services provided by BURD Home Health, you also agree to release BURD Home Health from any and all claims, causes of action, lawsuits, injuries, damages, losses, liabilities, or other harms resulting from or relating to calls, text messages, emails or other messages, including without limitation any claims, causes of action, or lawsuits based on any asserted violations of the law (including without limitation the Telephone Consumer Protection Act, the Truth in Caller ID Act, the CAN-SPAM Act, the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, the Health Insurance Portability and Accountability Act, any similar state and local acts or statutes, and any federal or state tort or consumer protection laws).

Sharing Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

 

Changes to this Statement

 

BURD Home Health reserves the right to change these Terms of Use from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating information on this page. Your continued use of the Site and/or Services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by that Policy.
